    yep. Your insurance company will have designated specialist claims investigators though - you can actually be pretty confident that they'll come to the correct decision. Just get them working on your behalf as early as possible. 

    also....dont be afraid to claim! If nothing else, you might get some extra gear funds :astonished: 
    I can't recall the process for my identical accident. There were no police in attendance so it was all down to individual recollections. ISTR that I wrote to the chap driving the car in front of me and he kindly sent me a copy of the letter he had sent to his insurers.

    I had a bit of an achey neck the next day, went to A&E but there was no lasting pain/effect and no injury claim. Hope the same's true here. (My mum was the passenger and her nerves were wrecked for a while, though.)

    It's a shame that an otherwise nice car has to be written off through no fault of your own, but hey, it gives you the excuse to buy something even nicer now. 

    You're more important, so wishing you a speedy recovery. Enjoy some time putting your feet up for the next few days if you can.

    Sorry about the car, nice as it is/was though, they are replaceable - people are not, glad the car did its job and came off worse than you did...... not that I'm *glad* about any of it, but I'm sure you catch my meaning.

    Wishing you a speedy recovery.
    One of the van drivers in my old job was involved in a multi car shunt. He was in the vehicle at the back and was deemed liable for hitting the car in front of him, as he should have left enough distance between them to avoid any incident.
    The car/cars behind you should be found responsible for shunting you, it might be harder to prove that you didn't hit the car in front first though.

    It depends on the company and the circumstances. I didn't lose mine when someone drove into the side of my car out of a side road and there was no question of any liability on my part. I still have full no-claims and my premium didn't go up.

    I'm currently an underwriter, predominantly for motor policies, but I can't speak for all insurers. 

    Any claim where a cost cannot be recovered from a third party insurer will always go down as fault. 


    With the majority of insurers (to my knowledge), if the claim closes non-fault, the bonus is very likely to be allowed. Which means it will not be impacted or stepped back. 

    For a fault claim though, it will be stepped back. Depends on your insurers step back charts (it'll be in your policy docs). 

    Some places allow you to pay back the costs incurred following a fault claim, this may mean you can retain your ncd. 
    however, claim costs can easily reach into the tens of thousands, and more if PI is involved. 

    The thing to remember is, even a non-fault claim could effect your premium, as some insurers do rate on them. 

    Best thing to do though, get a dash cam.
    Any third party insurer cant argue video footage of being hit from the behind. 

    And if you can, protect your ncd!

    Thankfully it sounds as if you have been relatively lucky & will make a full recovery.

    This shit is why I now have front & rear video camera's in my car.
    I'm not paranoid, the bastards ARE out to get me.

    Yikes! Scary biscuits! 

    I have a front view dashcam after a near miss last year but might be worth having another facing rearward after seeing those vids. 

    My cam does have the option to add a rear cam but it reduces image quality so might be just as well having a dedicated rear facing camera for what they cost.

    The problem is when the TP is a lying cretin and says you reversed into them. 

    This happened to me, on a roundabout. 

    No logical being would have accepted I did that. But it went 50/50!
    The only easy day, was yesterday...

    That's the car that did it. Frankly, I'd be bloody impressed it my car could've done that in reverse. Particularly on the A1 at rush hour :D
