the first is in the Employer -v- Employee relationship and thus is under 1 set of rules. AND is currently being appealed where I expect it to be reduced by a shitload.
the 2nd is not an employer situation and is under a different set of rules, and thus comes down to whether the reporter was actually in fear of being slapped. If not - then nothing. If yes - then causing fear in another person is Assault (Public order offence) and there can be damages, probably of about £500 to £1500. It doesn't affect her job / employability etc.

Yes, I get that a physical threat from a man against a woman can be taken as more threatening because of the perceived physical advantage the man has over the woman, but in this instance it wasn't taken as a genuine physical threat, more of an exceedingly crass and twattish comment.
