    You're confusing condition with new-ness. A shop-soiled guitar is still brand-new and will still come with a warranty.

    In the same condition as when purchased brand new, whatever that condition may be. A relic can be as-new - it doesn't mean it's pristine.

    No-one expects a relic'd guitar to be pristine but most people would expect a new non-relic guitar to be pristine.

    It seems you're talking about the legal definition whereas I'm talking about the common-sense view so in that sense we're not going to agree.

    ^^ I think we can agree that (a) it's likely a cracking guitar, (b) it's in excellent condition, and (c) the asking price of £1,700 is fair and reasonable.
