Distance selling regs. Advice plse

Just bought an item, but wrong size.
Seller won't exchange it as I no longer have the box/wrapping.
Are they right in their refusal or should I argue the point?

I think you're on the hook for it. How can they resell if it no longer has its original packaging?

Some retailers have in their terms and conditions that returns must be received in the original packaging, but they can’t insist on that if it’s not possible or practical. The regulations specifically state – 

Packaging: You may ask customers to take care when they open the package or return goods with the original packaging, but you cannot insist on this.

Thank you for the advice. I have managed to sort things out with the dealer and the item is going to be able exchanged.
What is it? Horse riding leathers. Guitar Weasel will understand!!
