Part ex car return rights

What's Hot
Long story short - traded Focus in for Skoda Octavia.
2 hours after I pulled away, noticed a dent in the door (not me, of course!) and 3 hairline scratches.
Dealer said he could get somebody to look at it but it's been over a week and not had any contact.
Also I notice a lot of low-frequency acoustic noise at low speed over rough road, enough to ruin it for me.

I read there is a 30 day consumer law return law.. I quoted this in an e-mail to the dealer (I'm annoyed I think they're fobbing me off, also, so I'm sticking it to them) but I'm not 100% sure what this entails. I drove away with the scratches and dent already there - am I on a hiding to nothing? What about the bad acoustic noise?

    Aren't all noises acoustic noises?

(Edit: First person to post up a Marshall wall loses all points)

Sure I read something recently about that noise being a common complaint with Octavias. Good luck anyway.

    Not a clue.

Scotchland law is different in many ways.

    :)

It's at low speed over uneven roads, it sounds like you're sitting in a Chinook helicopter. Lack of insulation or some structural design flaw - not sure. Should have got the Honda diesel - but now I see potential diesel taxes I wouldn't know what to go for.

It sounds like a Chinook and you are complaining?

Dude - that would be awesome!

Just play Ride of the Valkyries really loudly every where you go! :D

Dents and scratches noticed after the event are awkward as we wouldn't know when it was done.

Ive had plenty of people quite obviously damage it themselves and claim it was there before.

We normally just end up paying for it as it's not worth the hassle.

I wouldn't expect a noise that you didn't like would be grounds for return, it's aimed at serious faults with regards to engines/gearboxes etc.

Yeah I may be on a sticky wicket.
What will probably happen is I keep it for as long as I can bear it then trade it in for something else.

  • Have you checked all windows are shut including rear windows?

If I have my rear windows down at speed I get terrible noises but I've never had anything other wise and I've done around 100k in Octavia.

    The windows are shut.
With one rear window open the noise is terrible. It's common with many cars, apparently, but I never had it with Ford.
Apparently it's common with the MkIII Octavia. There are 40+ page threads on it on the UK and German Skoda forums.

I've had the same with plenty of cars with one rear window down.

VW, SKODA, Citroen, Kia, Ford, Vauxhall, BMW, Seat, Peugeot, Volvo and probably others.

If you're not happy, and there's a 30-day return, return it now. Do not take no for an answer. I didn't notice this in any of my Octavias but they were all estates.

You've got enough to deal with; if you can ditch the car now, do so. Good hunting.

I agree but the point is that I don't know my rights. Do they have to prove there is a fault and if so, assuming they won't recognise the thrumming issue... And the dent "could have" been done by me (it wasn't though!) I think I might be seriously out of pocket if wanting to sell. Sold that PRS to help fund this, too. Bummer!!!

With one or both rear windows down at speed you can get a resonance around the window opening.
If you close the window a bit the pitch will change.

Car was 10450, webuyanycar say 9.7k trade in. Dealer hopefully offer a bit more. I swear I've had a sore back since I got it, too. I might just have to take the hit. :(

Return it as unfit. Start polite, and then escalate until it's easier for them to pay you off than argue.

Surely there are scales of unfit though.. everybody else who's been in it says it's fine. You'd think I was mental but it's will documented by owners online. If I was the sales guy I'd even have doubt if in his shoes.
